Introduction

Welcome to Real Mortgage Secrets (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website [www.RealMortgageSecrets.com] and our services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Use of Our Services

You agree to use our services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the services. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our services.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Real Mortgage Secrets and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Real Mortgage Secrets.  Digital recording and subsequent distribution of Real Mortgage Secrets content, both publicly and privately, is prohibited unless agreed to in writing by Real Mortgage Secrets and we reserve the right to pursue legal action in the event of such violation.  This also applies to the sharing of subscriber login credentials with any other party other than immediate household family members.

Termination

Use of services, both free and paid, are for a term of twelve (12) months from the date of order fulfillment.  Upon completion of term, said services must be resubscribed for in order to obtain information. We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately, and the extent of financial remuneration of Real Mortgage Secrets will be limited to the amount(s) of subscriptions paid for. 

Limitation of Liability

In no event shall Real Mortgage Secrets, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party. In no event shall Real Mortgage Secrets be liable for any claims, damages, or losses exceeding the amount you paid to Real Mortgage Secrets for use of the service.

If consultation services are subscribed for from Real Mortgage Secrets, it is understood that all guidance and advice is offered in good faith and in the best interest of the subscriber.  Opinions, suggestions and strategies recommended are based on the real-life experiences of our staff and carry no guarantees of results.  The choice to follow and execute the advice and strategies offered by Real Mortgage Secrets lies solely with the subscriber.  

Finally, it is impossible for Real Mortgage Secrets to know in advance the level of knowledge or understanding that a subscriber may already have in regard to mortgage loans and the home purchase process.  It’s possible that a subscriber may purchase a subscription to an item of knowledge that the subscriber already knows.  Real Mortgage Secrets cannot refund monies for any items subscribed to if that item is already known by the subscriber.  

Governing Law

These Terms shall be governed and construed in accordance with the laws of Kootenai County, Idaho, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service and supersede and replace any prior agreements we might have had between us regarding the service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
